Terms of Service

1. Acceptance of Terms

By registering for or using the Qupons Biz platform (“Service”), you agree to be bound by these Terms of Service. If you are using the Service on behalf of a business, you represent that you have authority to bind that business. If you do not agree to these Terms, do not use the Service.

2. Service Description

Qupons Biz is a SaaS platform for independent restaurants that provides loyalty campaign management, order management, customer database, AI-powered menu tools, push notifications, QR scan terminals, team management, and analytics. The Service is provided on a monthly subscription basis.

3. Subscription and Billing

  • Free Trial: New accounts receive a 30-day free trial with full access.
  • Subscription Fee: $100 USD per month after the trial period.
  • Billing: Billed monthly via Stripe. Automatic renewal unless cancelled.
  • Cancellation: Cancel anytime. Service remains active until end of billing period.
  • No Commissions: Qupons Biz charges a flat monthly fee only. We take 0% commission on any orders, transactions, or customer spending at your restaurant.
  • Refunds: Monthly subscription fees are non-refundable except as required by law.

4. Account Requirements

  • You must be 18+ years old and operate a legitimate food service business.
  • Your business must be verifiable via Google Places during onboarding.
  • You are responsible for maintaining the security of your account credentials.
  • You must promptly remove staff access when they leave your business.

5. Campaign Rules

  • Campaign discount rates (instant discount, store credit, referral bonus) are locked upon publishing and cannot be modified.
  • Maximum instant discount: 50%. Maximum store credit: 30%. Maximum referral bonus: 15%.
  • Campaigns must not overlap in time slots. The platform enforces this automatically.
  • You must honor all campaign rates shown to customers when they place orders during active campaign periods.
  • Fraudulent or deceptive campaigns violate these Terms and may result in account termination.

6. Customer Data

You may access customer data (order history, credit balances, visit frequency) for business management purposes only. You may not export, sell, or use this data for purposes outside the Qupons platform. Customer phone numbers are masked after 7 days. Customer email addresses are never visible.

7. No-Show and Strike Policy

The Qupons platform enforces a no-show strike system on consumers, not on merchants. However, merchants must not abuse the void or refund system. Voiding transactions outside the 24-hour window or systematic credit manipulation may result in account suspension.

8. Prohibited Uses

  • Using the platform to process fictitious orders or fraudulently generate credits
  • Attempting to reverse-engineer, scrape, or circumvent platform security
  • Using customer contact information for purposes outside the Qupons platform
  • Operating multiple accounts for the same business location
  • Violating any applicable laws or regulations

9. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We are not liable for losses resulting from service downtime, data loss, or third-party service failures (Stripe, Google, Firebase, Twilio). Planned maintenance windows will be announced in advance.

10. Intellectual Property

You retain ownership of your business content (photos, menu items, descriptions). By uploading content, you grant Qupons a license to display it within the platform. Qupons retains all rights to the platform software, design, and technology.

11. Termination

We may suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or fail to pay subscription fees. Upon termination, your data will be retained per our data retention policy (7 years for financial records, anonymized) and then deleted.

12. Limitation of Liability

To the maximum extent permitted by law, Qupons' liability is limited to the amount paid in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, lost profits, or data loss.

13. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance. We will provide 30 days' notice for material changes affecting your billing or rights.
